    Medical facilities to non-pensioners of the military: Historic day for Short Service Commissioned Officers, Emergency Commissioned Officers, World War II veterans and pre-mature retirees



    The Cabinet has today extended the Ex-Servicemen Contributory Health Scheme (ECHS) to the above categories of non-pensioners of the military.

    Non-pensioner ‘ex-servicemen’ were initially granted medical facilities in Military Hospitals in 1970 but the same were discretionary. Later, ‘pension’ was made mandatory to avail such facilities. Again in 1997, the term ‘ex-pensioners’ was replaced by ‘ex-servicemen’ thereby restoring the facilities to non-pensioners having ‘ex-servicemen’ status such as Short Service Commissioned Officers and Emergency Commissioned Officers (SSCOs and ECOs) who were made entitled to Outpatient (OPD) facilities. However, in the late 2000s, the facilities were withdrawn by the office of the Director General Armed Forces Medical Services (DGAFMS) despite stiff resistance by the Army HQ.

    The matter went into litigation wherein the Chandigarh Bench of the Armed Forces Tribunal (AFT) ultimately directed the Government to restore the facilities to the affected ex-servicemen. The Government though filed an appeal in the Supreme Court against the verdict of the AFT.

    The matter was referred to a Committee of Experts, of which I too was a Member, which, after deliberating the subject, recommended the following:

    (a) Existing limited outpatient medical facilities in MHs to non-pensioners holding the status of Ex-servicemen to continue as per already approved instructions and Services HQ to continue issuing and honouring Medical Entitlement Cards for such facilities as was the case till late 2000s. The entitled non-pensioners also continue to be eligible for medical reimbursement from Kendriya Sainik Board. It may be pointed out here that the said facilities are anyway not entitled to be granted to re-employed ex-servicemen or those who are members of any medical scheme.

    (b) The unethical appeal filed against grant of such facilities to own personnel to which actually they were legally entitled to, be immediately withdrawn and such ego-fuelled actions be avoided in the future. We wish such persistence and exertion in pursuing such misdirected litigation is rather used for constructive activities.

    (c) ECHS facilities for SSCOs as mentioned, as already approved in-principle by the then Raksha Mantri and mentioned in the Parliament on the floor of the House, be implemented forthwith by overcoming all objections. The same be made applicable to all SSCOs and ECOs and all other personnel released without the benefit of pension but on completion of terms with a gratuity, present and former, with certain amendments as deemed appropriate such as that the scheme can only be extended to the officer and spouse alone and that it would not apply to those who are re-employed with a cover of an organizational medical scheme. The issue of financial implication may not be relevant since firstly the scheme is contributory in nature, and secondly, the then Raksha Mantri has already made a statement to the effect on the floor of the house. Besides bringing succour to our veterans, it would act as a major morale booster to the rank and file and also help attract talent to the Short Service Commission Scheme.

    (d) It is recommended that the Government must go all out to bolster the resources of the military medical establishment since they are rendering impeccable services in trying circumstances to our men and women in uniform. There should never be an occasion wherein doctors perform duties under pressure. An environment free of all encumbrances, external constraints and stress must be ensured for the medical establishment to function in an efficient manner

    The recommendations were accepted by the then Raksha Mantri Mr Manohar Parrikar but were not given effect to for a long period. The Supreme Court had taken a grim view of the delay and had asked the Government to resolve the matter by April 2019.

    The Cabinet has today approved the extension of ECHS to various categories of non-pensioners of the military and it is understood that on the appreciable insistence of the current Raksha MantriMs Nirmala Sitharaman, even other categories such as pre-mature retirees, which were not covered in the recommendations of the Committee of Experts or by judicial dicta, have also been brought in the ambit of the scheme. 

    Broadly speaking, eligible beneficiaries and their spouses would be entitled to absolutely free Outpatient (OPD) facilities at ECHS polyclinics, however treatment and In-patient (IPD) facilities at ECHS empanelled hospitals would be on payment basis. Further, 50% of such expenditure would be reimbursable for personnel with 10 years service or less and 75% would be reimbursable for those with more than 10 years of service. 

    This marks a closure to long drawn travails of affected officers and personnel. My congratulations to them.

    CLARIFICATION ON YOUR ADDRESS TO EX SERVICEMEN AT DEHRADUN ON 04 MAR 2019

    Hon’ble Raksha Mantri,

    1.        Please refer our letter dated 05 Mar 2019 (copy attached).

    2.       During your address to Ex Servicemen, you had touched upon a few important issues of defence personnel ie OROP and minimum pension.

    3.       May I request you for clarification necessary on the above issues as per succeeding paragraphs:-

    (a)

    OROP.  You had stated that the review of OROP will be carried out after three years and the same will be done this year.  If the Govt had decided equalization of pension every three year, then the review is due with effect from 01 Jul 2017.  In that case the Govt Notification needs to be issued to execute equalization of pension of defence personnel with effect from 01 Jul 2017.  If it is carried out this year i.e. 01 Jul 2019,  the equalization of pension would be after five years and not three years as stated by you, since OROP was granted by your Govt with effect from 01 Jul 2014 vide Govt Notification dated 07 Nov 2015.  This important issue needs to be clarified.  May I request you for early clarification please?

    (b)

    Minimum Pension of Rs 18000/-pm.  During your address, you had stated that the minimum pension which is Rs 10,000/pm as of now will be increased to Rs 18,000/-pm.  As per the existing order, minimum pension is  Rs 9,000+DA.  Will the pension of widows and reservists be increased to Rs 18000/-pm + DA as stated by you?  If it is so, it is very welcome decision by your Govt.  Defence widows and reservists are the most effected pensioners of def family.  May I request for your consideration and early clarification please.

    3.       May I also request you for meeting for half an hours of three members of Indian ex servicemen (IESM) at your earliest please.

    Sub: Revision of pension of pre-2016 pensioners/ family pensioners in implementation of Government’s decision on the recommendations of the 7th Central Pay Commission Concordance tables- regarding.


    Sir,


    The undersigned is directed to convey that instructions were issued for revision of pension/family pension with effect from 1.1.2016 in respect of Armed Force pensioners/ family pensioners who retired/ died prior to 1.1.2016 vide this Ministry’s letter No. 17(01)/2017(02)/ D(Pension/Policy) dated 5.9.2017. As per the same, revision of pension for pre-2016 Armed Force pensioners/ family pensioners under first formulation, was to be done by notionally fixing their pay in the pay matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale/ pay band and grade pay at which they retired/died. The notional pay fixation in 7th CPC pay matrix has to be arrived by fixing pay under each intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non Practicing Allowance, where applicable, and X! Group pay & Classification Allowance for JCO/ORs, if applicable, notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emolument as on 1.1.2016 for determining the revised pension/family pension in terms of para 5 of this Ministry’s letter dated 5.9.2017.


    2. Based on past instructions on fixation of pay in various pay commissions, concordance tables for fixation of notional pay for Armed Force personnel who retired/died in various ranks during the 4th, 5th and 6th Pay Commission periods including 3rd Pay Commission for Sailors only) have been prepared and the same are enclosed herewith. In the case of commissioned officers who retired/ died in harness before 1.1.1986, these concordance tables may be used based on their notional pay as on 1.1.1986, which was fixed in accordance with this Ministry’s letter No 1(3)/98/D(Pen/Policy) dated 27.5.1998. Concordance tables for JCO/ORs who discharged/ died in service prior to 1.1.1986 (prior to 1.1.1973 for Sailors), are under preparation and shall be issued separately.


    3. These concordance tables have been prepared to facilitate fixation of notional pay of pre-2016 pensioners/ family pensioners by the concerned Record Offices and attached Pay Account Offices in case of JCO/ORs of the three Services and PCDA(0) Pune/ Naval Pay Office, Mumbai / AFCAO New Delhi in case of commissioned officers of Army / Navy / Air Force respectively. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 3rd to 4th (only for Sailors), 4th to 5th, 5th to 6th and 6th to 7th Pay Commission. In case of any inconsistency in the concordance tables vis-a-vis the relevant rules instructions, the notional pay and pension family pension of pre-2016 pensioners / family pensioners may be fixed in accordance with the rules / instructions applicable for fixation of pay in the intervening Pay Commission periods.


    4. The pension / family pension of pre-2016 Armed Forces pensioners/ family pensioners may be revised, using the appropriate concordance table in accordance with the instructions contained in this Ministry’s above quoted letter dated 5.9.2017.


    5. This issues with concurrence of Ministry of Defence (Finance/Pension) vide their UO No. Part.file 1 to 30(01)/2016/Fin/Pen dated 27.09.2018.

    The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved the setting up of 50 new KendriyaVidyalayas under Civil/Defence Sector all over the country.


    The Vidyalayas are proposed to be opened in the Civil/Defense Sector and once they are fully functional they will provide quality education to approximately 50,000 students once they become fully operational.

    HOSPITALS FOR 64 KB CARDS HOLDERS

    General

    1. The new 64 Kb Smart Cards have been collected by a number of ECHS beneficiaries and are now in use at various Polyclinics. The new hardware has already been issued to all the Polyclinics and are being installed  in  phased manner by the vendor. At present, installation of new equipment for all the Polyclinics under Regional Centre Delhi-I and Regional Centre Delhi-II is complete and functional. To ensure 64 Kb Cards holders get referral to the empanelled Hospitals through the new system, (where new hardware & software  has been installed) on online software solution has been implemented. The  detailed procedure  is given at succeeding Paragraphs.

    Action at the Polyclinic

    2. Action by the ESM  The ECHS beneficiaries on reaching the parent Polyclinic will register and select a Doctor to be consulted through the Kiosok/ iCAT and a token will be generated which will have a queue number.

    3. The ECHS beneficiary will report to the Doctor as per his token/ queue serial. Based on his medical condition either he will be disposed off at the polyclinic or he will be referred for further treatment to any Empanelled medical facilities, located within the area of responsibiliy of concernei:l Regional Centre (No hospital will be specified). He will be issued with a referral form which will have a Referral Number and basic details of the beneficiary. A sample Referral form is attached as Annexure I.

    4. Action by the OIC Polyclinic  The Referral Form will be digitally signed by the OIC, Parent Polyclinic,  hence, not required to be physically signed.

    Action at the Empanelled Hospital

    5. The ECHS beneficiary on reaching the Empanelled Hospital of his choice, within the area of responsibility of the Regional Centre will provide his referral form and his 64 Kb Card to the hospital. The Empanelled Hospital will access the UTI-ITSL site and feed the Referral Number. A Claim ID will be generated from the UTI-ITSL site and the Referral Number and Claim ID will get locked. The Referral Number,   now cannot be used at any other Empanelled Hospital.

    6. Referral to Empanelled Hospital outside the Area of Responsibility of the Regional Centre of the Parent Polyclinic The procedure to be adopted by ECHS beneficiary to take referral to an Empanelled Hospital outside the area of responsibility of Regional Centre of .parent polyclinic is given as under :-

    (a) He will  obtain a referral from his parent  polyclinic for the specified medical condition. (b) He will online identify the Empanelled Hospital where he wishes to take medical treatment. Based on the Hospital location he/she will identify polyclinic closest to the empanelled facility where treatment is desired. Visit the polyclinic and register on the Kiosk/iCat and select a Doctor and generate token & queue number. (c )   Meet the Doctor as per his queue number and take a referral. (d) The Doctor will enter the Referral Number in his module and an auto populated Referral Form will be displayed to the Doctor. The Doctor will generate the Referral and this will have new Referral Number and  the earlier Referral Number will become ineffective. (e) Consequent to the approval by the OIC polyclinic, a digitally signed printout will be generated with new Referral Number duly entered with the original (old Referral number,which is rendered ineffective)Referral Number. The earlier Referral Number will become ineffective. (f) The ECHS beneficiary will visit the chosen Empanelled Hospital and produce their Referral and the new 64 Kb Card. (g) The hospital will access the UTI-ITSL site and once the new Referral Number is entered a claim ID will be generated and both the Referral Number and claim ID will get blocked.  This Referral Number now cannot be used  at any other Empanelled  Hospital.

    Action incase where New Equipment  is Not Installed or is Non Functional

    7. In case where the new equipment has not been installed or is non functional, then the referral will be generated through the existing system.

    8. This information will be disseminated to all Polyclinics and displayed at prominent places for information  of ECHS beneficiaries.

    9. All Regional Centre, Directors to ensure this information is conveyed to the empanelled facilities under respective Regional Centres.

    Subject: No requirement of an NOC for the renewal/change of address in the Driving Licence

    Madam/Sir,
    The driving license issued by any licensing authority in any state is valid throughout India and the license-holders is authorized to drive the specified class or classes of vehicles as per the licence in terms of the provisions of the motor vehicles Act, 1988 or the or the Central Motor Vehicles Rules, 1989.

    2. The practice of obtaining an NOC from the previous licencing authority was followed primarily with a view to checking the authority of the licence,as to whether it was indeed issued/endorsed by the previous authority and that the licences was not linked with any offence. This practice came to be adapted initially when the Diving Licences were issued in manual mode/regime and also subsequently during the decentralized operations of earlier off-line software versions of SARATHI. Now, with the current version of SARATHI Wherein all Driving Licenses are issued following a IT based application system and the details are verifiable from the database in an on-line mode, there is no need for seeking an NOC for verification of such details as per the provisions of the aforesaid Act or Rules.

    3. It has been brought to the notice of this Ministry that many States are still sticking to the practice of obtaining NOC from the parent authority in both cases. i.e renewals and change of address of the driving licence. This not only caused disparity in the implementation process but has a potential of undue harassment to the applicant. In case, when a user moves from one place or State, which does not issue NOC to another place or State, which requires an NOC, the applications are rejected due to the lack of such NOC.

    4. The SARATHI database contains the information of the driving licences issued by the states. Accordingly, it is advised that whenever an application for renewal or transfer of address is reserved the concerned competent authority may check the particulars online available in the SARATHI database Further, the details can also be validated using e-challan mobile application. This approach would not require the citizens to visit or approach the original Licencing Authority for getting NOC.

    5. It is requested that all the Licensing Authorities be directed to stop forthwith and discontinue any old process of verification in manual mode and follow the online verification of the driving licenses for facilitation of the citizens

    "In the first major restructuring of the Army headquarters in the national capital, the Ministry of Defence is learnt to have reduced some 20 per cent of the officer posts, merged two weapons and systems procurement agencies and created a new post of Deputy Chief who will coordinate with military intelligence, operations and logistics wings."
    The 20%Reduction in Officers Posts Will Soon Be Filled Up By the Civilian Babus in the MoD and the Army, Will Never Ever, Be Able to get Back these Posts. This Move, Will Surely Result, in More problems for The Faujis, in the Near Future and Beyond. Reminds me, of the Short Sightedness of the Fist Indian C-in -C Gen Cariappa, who moved out Faujis from the MoD, stating that Soldiers were supposed to Fight and be in the Field and Not be pen pushing BaBus, in the MoD. Those Posts in the MoD were Forever Lost to the Military. That Error of Judgement, Was there, for all Faujis to See, Experience and Regret.Unfortunately, the Military seems .Not to have, learnt any Lesson from that Sorry Episode.Period.

    More than 40,000 individual to be benefitted


     


    The Cabinet Meeting Chaired by Prime Minister Narendra Modi today approved the grant of Ex-Servicemen Contributory Health Scheme (ECHS) facilities to World War-II Veterans, Emergency Commissioned Officers (ECOs), Short Service Commissioned Officers (SSCOs) and pre-mature retirees.

    As a result, over 43,000 individuals not covered so far under ECHS will be able to avail the benefits of cashless medical treatment under ECHS facilities through a network of over 425 ECHS polyclinics, over 2500 empanelled private hospitals and all Government hospitals throughout the country, subject to certain conditions.

    As a special dispensation, war-widows will be exempt from one-time contribution to join ECHS.

    Launched by NDA Government in April 2003, ECHS provides quality medicare to 54 lakh ex-servicemen pensioners, their dependents and a few other categories.

    Measures for welfare of Ex-Servicemen:

    Today’s decision is yet another landmark step in the pro-active policies of the Government since its very first days for welfare of our valiant ex-servicemen, who rendered valuable service to the country.

    Implementation of ‘One Rank One Pension’ for ex-servicemen, a demand which had been pending for over four decades, has resulted in over 20 lakh ex-servicemen receiving more thanRs. 35,000 Crore under the scheme. Other welfare measures by the Government for ex-servicemen include increase in pension by 40%, disability pension for pre-mature retirees, applicability of battle causality compensation at Line of Actual Control, Line of Control and International Border, financial assistance to soldiers on their supreme sacrifice through newly created Army Battle Causalities Welfare Fund, enhancement of ex-gratia ad-hoc allowance, Special Pension to Ex-sailors and skill development training in 36 job roles to over 30,000 retiring soldiers so far.

                   New Delhi: In a first, an officer from the Indian Police Service (IPS) will soon be posted at the Indian Army headquarters in the national capital to assist the force in dealing with human rights issues.
    Approved under a plan called ‘Reorganisation of the Army headquarters’, the move is part a major restructuring of the armed forces, said sources.

               Under the plan, the defence ministry has also approved the Army’s proposals to reduce around 20 per cent of the officer posts, merge two weapons and systems procurement agencies and create a new post of deputy chief who will coordinate with military intelligence, operations and logistics wings, said sources.

                 A formal notification is expected soon.

                The move is part of an overall process to make the 1.3-million strong Indian Army leaner and fitter for a 21st century war.

                The Army had earlier commissioned four major in-house studies for greater integration. This restructuring is part of one of the four studies.

                 According to the approved proposals, two new branches have been created — for Vigilance and Human Rights — within the Army. Both will be headed by a Major General-rank Army official.

                 The new Additional Director General (ADG), Vigilance, will function directly under the Army chief. The ADG Human Rights will function under the vice-chief.

                    The ADG HR — a post to be held by an Army official — will be assisted by an IPS officer to facilitate necessary coordination with other organisations and the home ministry on the human rights issues at hand, sources said.

                  It’s not yet clear what the rank of the IPS officer will be.

                    Since an ADG HR will be equivalent to an ADG in the police forces, a lower rank officer will be deputed to the Army headquarters.

    Please familiarize yourself with Kendriya Vidyalaya Sangathan (KVS) admission rules, regulations and guidelines available at http://www.kvsangathan.nic.in/AdmissionGuideLine.aspx.
    You are strongly advised NOT to submit multiple applications to the same Vidyalaya for the same child. If any Vidyalaya detects multiple applications for the same child, all applications of the child to that Vidyalaya will be considered null and void.

    a valid mobile number with Indian SIM card,
    a valid email address,
    a digital photograph or scanned photograph of the child seeking admission (JPEG file of size at most 256KB),
    a scan of the child’s birth certificate (JPEG or PDF file of size at most 256KB),
    details of government certificate in case you are applying under economically weak section, transfer details of parent/grandparent whose service credentials will be used in the application.
    There are two necessary steps involved in successfully submitting an application form.
    Registering on the portal: On successful registration, you will be assigned a unique Login Code. Please note down your unique Login Code carefully.
    Filling and submitting application: The Login Code obtained after registration must be used to login and fill the online application form. You can indicate choice of up to three (3) different Vidyalayas in India, without any preference between Vidyalayas, in a single form. After filling in the application form, it must be submitted by clicking on the Submit Application button. On successful submission, you will be assigned a unique Application Submission Code, that is different from the Login Code. You will also be shown a list of original documents to be submitted to a Vidyalaya at the time of admission in case provisional admission is offered by the Vidyalaya. Please note down your Application Submission Code and the list of documents to be submitted at the time of admission carefully.
    Only after both steps 5a and 5b above have been completed, is the application process completed. Completing only step 5a will NOT result in your application being submitted to KVS.
    Your application is NOT submitted and your application data will NOT be visible to KVS until you receive an Application Submission Code from the online admission portal.
    Completing the registration and submitting an application requires use of one-time password (OTP) that is sent by SMS to the mobile number provided during registration. You are strongly advised to register your own mobile number (with Indian SIM card) and not that of relatives, friends, agents, cyber-cafe operators or others.
    Details provided at the time of registration cannot be subsequently changed in the admission form. Please enter these details correctly and exactly as per documentary evidence (like birth certificate) available with them.
    In the application form, a Save Application button has been provided to help you save (possibly partially filled) data, and resume filling the form at a later time.
    By clicking the Save Application button, the form is only saved for you to continue filling it in a later session. The form is NOT submitted to KVS by clicking on the Save Application button. The only way to submit the form to KVS is by clicking on the Submit Application button after filling in the entire form, at the end of which an Application Submission Code is generated.
    Once an application form has been submitted and Application Submission Code generated, the submitted application form cannot be edited.
    If you realize that incorrect information has been submitted in your application, you have the option to cancel your submitted application. Canceling a submitted application requires use of an OTP that is sent to your registered mobile number. This is meant to prevent accidental cancelation of a submitted application. An application, once canceled, cannot be revived, and the Application Submission Code for the application becomes null and void. Data from a canceled application form will NOT be visible to KVS after cancelation of the form.
    After canceling a submitted application, you can re-apply using the same Login Code before the last date of submission of applications. However, this will be treated as a fresh application, and must be filled in and submitted all over again. A new Application Submission Code will be generated when the fresh application form is submitted.
    Only your Application Submission Code (and not your Login Code) must be used for all communication with KVS and with the Vidyalayas you have applied to.
    All fields in the online form marked with a red * are mandatory, and must be filled in. The portal will not allow you to proceed until all mandatory fields are filled in.
    For admission application under Special Provisions as detailed in KVS guidelines (http://www.kvsangathan.nic.in/AdmissionGuideLine.aspx), except in Single Girl Child category, please submit the online application form through the portal, and then contact the Principal of the concerned Vidyalaya directly (not through the admission portal), citing your Application Submission Code along with all documentary evidence required for applying under ‘Special Provisions’.
    For admission application in Single Girl Child category, please submit the online application form and upload required documents like any other admission application. There is no need to contact the Principal of the Vidyalaya (to which the child is seeking admission) directly in this case.
    For twins/triplets/… who are eligible for admission in Single Girl Child category as per KVS guidelines (http://www.kvsangathan.nic.in/AdmissionGuideLine.aspx), you must register, fill in and submit the online application form separately for each sibling. To ensure that the applications are considered together for admission in Single Girl Child category, the individual applications must be linked using a Linking Code generated by the online admission portal. Please see detailed instructions for generating and using Linking Code in point (xi) of Section (2.4.1) of instructions (Instructions for filling in admission application form and uploading documents).
    Mere registration and submission of the application form DOES NOT confer a right to admission to any child. Admissions will be offered by individual Vidyalayas, depending on available seats and as per KVS guidelines (http://www.kvsangathan.nic.in/AdmissionGuideLine.aspx) after examining application details, and after originals of all required documents have been produced at the time of admission.
    Please check the results/shortlists of admissions with individual Vidyalayas on the dates announced by KVS/individual Vidyalayas for declaration of admission results.
    In case provisional admission is given by a Vidyalaya after the results are announced, originals of all supporting documents listed while submitting the form must be presented to the concerned Vidyalaya at the time of admission. Failure to provide these original documents may lead to the admission being canceled.

    Types of Complaints

    There are broadly two types of complaints.

    a) Relating to grant/revision : For redressal of their grievances relating to pension sanction/revision, individual should first approach his Head of Office/ Record Office from where he retired/discharged , as the claims are initiated by them to the office of the PCDA (P).

    Except in the case of Commissioned Officers whose PPOs are sent by PCDA (P) direct to PDAs and they can write to Grant- I Military section.

    In case of Air Force Officers and personnel discharged on or after 1.11.85, complaints/grievances may be addressed to DCDA (AF), Subroto Park, Delhi Cantt. as they are the concerned Pension Sanctioning Authorities.

    In case of Naval officers/ personnel discharged on or after 1.11.85 the complaints may be addressed to CDA (Navy),No. 1, Cooperage Road, Mumbai-400039 email-id cdabombay@hub.nic.in as they are the concerned Pension Sanctioning Authorities.

    In case it is informed by your Head of Office/ Record Office that your pension case is pending with Pr. CDA (P), Allahabad, then please quote letter No. and date under which claim has been sent to this office and also quote your original PPO number in case the complaint relates to revision or issue of corrigendum PPO.

    Every year, Pr. CDA(P), CDA(PD) Meerut and CDA Chennai hold 4 Defence Pension Adalats in different parts of the country and wide publicity is given for the same in News papers etc.The month and place of the next Adalat will also be displayed under 'What's new' on this Web Site. Any grievance in respect of pension sanction/payment, received by the Pension Adalat Officer is settled in a time bound manner and the pensioner is informed.     Commutation of Pension

    An officer is entitled to commute for a lump sum payment a fraction not exceeding 50% of his/her pension which is sanctioned for life.

    Commutation of pension if applied after one year of retirement/invalidment is to be submitted through pension disbursing authority. In such cases, commutation is to be done after medical examination only.

    Calculation of Commuted value of Pension

    The commutation of pension is calculated as under:-

    Portion of monthly pension to be commuted x 12 x purchase value applicable to the age next birthday.

    Note : The table of commutation of pension is given in MOD letter No. 17(4)/2008(2)/D(Pen/Pol) dt 12.11.2008.

    Restoration of Commutation portion of Pension

    The pensioners who have commuted a portion of their pension and on 1.4.1985 or thereafter have completed 15 years or will complete from the respective dates of retirement or from the date on which reduction in pension on account of commutation becomes effective will have their commuted portion restored.

    Restoration of Commuted Portion of Pension in case of Absorption

    The officers who had drawn lump-sum payment on absorption and have become entitled to restoration of 43% commuted portion of pension shall, apart from payment of revised restored amount of 43% commuted portion of pension, be also entitled to dearness relief on notionally revised full pension from the date of restoration. However, the officers who have opted for lump sum commuted value of their total pro-rata pension may get their pension restored to the extent of 43% after 15 years.

    Monetary Allownaces Attached to Gallantry Awards.

    The scheme of Gallantry Awards for Armed forces Personnel can be broadly divided into two categories i.e. Pre-Independence Gallantry Awards and Post-Independence Gallantry Awards. The Pre-Independence Gallantry Awards include Indian order of Merit, Military Cross, etc After independence different series of Gallantry Awards were introduced. The Vir Chakra series of awards are given for acts of conspicuous bravery/gallantry in the presence of the enemy and the Ashok Chakra series for bravery other than in the face of the enemy.

    These awards carry a monetary allowance with them which is payable for two lives.

    Invalid Pension

    Invalid Pension

    When on officer is invalided out of service on account of a disability which is neither attributable to nor aggravated by military service, he will be entitled to invalid pension, if service actually rendered is 10 years or more and invalid gratuity, if it is less than 10 years.

    The amount of invalid pension will be equal to the service element of disability pension that would have been admissible in case the causes were attributable to or aggravated by military service. Ranks for assessment of qualifying service reckonable towards invalid pension will be the same as for assessment of retiring pension.

    The invalid pension will be subject to the minimum of Rs. 3500/-PM w.e.f 1-1-06.

    Invalid Gratuity

    The amount of Invalid Gratuity shall be calculated at half a month's Reckonable Emoluments i.e. pay in pay band, grade pay, Military service pay, NPA, if any, last drawn and dearness allowance, for each completed six monthly, period of qualifying service. The Maximum limit of Invalid Gratuity is Rs. 10 lac.

    Liberalised Family Pension

    Liberalised Family Pension

    In case of an officer under the circumstances mentioned in category ‘D’ or ‘E’ eligible members of the family shall be entitled to liberalised family pension equal to Reckonable emoluments last drawn.

    Reckonable emoluments includes pay in pay band, grade pay, MSP and NPA, if any, last drawn.

    Liberalised Family Pension shall be granted to the widow until death or disqualification. If the officer is not survived by the widow but is survived by child/ children only, all children together shall be eligible for Liberalised Family Pension at the rate equal to Special Family Pension. Liberalised Family Pension shall be payable to child/ children for the period during which they would have been eligible as in the case of Special Family Pension. It shall be paid to the senior most eligible child at a time. On his/her death/ disqualification, it will pass on to the next eligible child.

    Liberalised Family Pension on Re-marriage of Widow.

    (i) If widow has children

    (a) If she continues to support children after re-marriage

    (b) If she does not support children after re-marriage

     

    Full Liberised Family Pension continue to widow

    Ordinary family pension equal to 30% to widow

    Special Family Pension @ 60% to eligible children.

    (ii) If widow has no children

    Ordinary Family Pension

    Ordinary family pension is payable to the widow and children of the officer who died/die while in service or after retirement with a retiring/disability/invalid/ special pension on account of causes which are neither attributable to nor aggravated by service.

    Elegible Members of Family for Ordinary Family Pension

    Wife lawfully married before or after retirement


    A judicially separated wife


    Son below the age of 25 years and unmarried daughter (including those illegitimate and adopted legally before or after retirement) or till the date of earning livelihood whichever is earlier.


    Widowed/ divorced daughter upto the date of re-marriage and until the earning is not more than Rs. 3500/- + DR p.m. whichever is earlier.


    Parents wholly dependant when officer has not left behind a widow/ widower, eligible son or daughter or a widowed/ divorced daughter and the earning of the parent is not more than Rs. 3500/- + DR p.m. The beneficiary is required to furnish income certificate by themselves. The family pension to parents will be admissible with effect from 1.1.1998 but will cover cases where death occurred even prior to 1.1.1998)


    In case of parents, the mother will receive the pension first. In addition to above, the following members are also eligible for ordinary family pension:-

    Handicapped children- son or daughter suffering from any disorder of disability of mind or physically crippled or disabled so as to render him unable to earn a living even after attaining the age of 25 years.


    Post retiral spouses-


    Children born out of void or voidable marriage


    Children born from divorced wife where conception took place before divorce.


    For the purpose of grant of family pension, the Family has been categorized as under vide GOI, MOD letter No. 17(4)/2008(2)/D(Pen/Pol) dt 12-11-2008.

    CATEGORY -I

    Widow or widower, up to the date of death or re-marriage whichever is earlier;


    Son / daughter (including widowed daughter), up to the date of his / her marriage / re-marriage or till the date she starts earining or up to the date of death, whichever is earlier.

    CATEGORY -II

    Unmarried / widowed / Divorced daughter not covered by Category I above up to the date of marriage / re-marriage or till the date she starts earining or up to the death of death, whichever is earlier.


    Parents who were wholly dependent on the Armed Forces personnel when he / she was alive provided the deceased personnel had left behing neither a widow nor a child.

    Family Pension to dependent parents, unmarried / divorced / widowed daughter will continue till the date of death.

    Ordinary Family Pension in case of Missing Personnel Pensioners

    Ordinary family pension in such cases is admissible to the eligible member of the family from the date of lodging FIR six months after the date of lodging FIR or expiry of leave of the officer who has disappeared, whichever is later.

    Rates of Ordinary Family Pension

    Normal Rate – The ordinary family pension at normal rate shall be calculated @ 30% of reckonable emoluments last drawn subject to a minimum of Rs. 3500/- p.m. and a maximum of 30% of the highest pay.

    Enhanced Rate - Where on officer dies while in service or after retirement with pension having rendered not less than 7 years continuous qualifying service, the enhanced rate is payable as under.

    Death in service :- The enhanced rate of ordinary family pension is payble for a period of ten years, without any upper age limit from the date following the death of the personnel, to the family of personnel who dies in service.

    Death after retirement :-E.R is admissible for 7 years from the date of death of officer or upto the date he would have attained the age of 67 years which ever is earlier in case of officer's death after retirement. The amount of enhanced rate whall be the lowest of the following amounts:

    50% of the reckonable emoluments


    amount of retiring/ invalid/ service element of disability pension


    For this purpose, reckonable emoluments comprises of pay in pay band including grade pay, Military service pay and NPA, if any, last drawn.

    Where an officer is invalided out of service on account of disability sustained under circumstances mentioned in category “E” , he shall be entitled to War Iinjury Pension consisting of Service Element and War Injury Element as follows :-

    (i)  Equal to Retiring Pension determined as per Para 6 of Military letter No. 17(4)/2008(2)/D(Pen/Pol) dt 12/11/2008 subect to Min. of Rs. 3500/-PM. There shall be no condition of minimum qualifying servie for earining this element.

    (ii)  equal to reckonable emoluments last drawn for 100% disablement. For lower percentage of disablement, war injury element shall be reducedpropotionality. The cap on War injury pension w.r.t. emoluments last drawn in case or disabled pensioners belonging to category E has been removed w.e.f 1-07-2009.


    War Injury Pension on Retention in Service


    An officer who is retained in service despite the disability due to war injury sustained under circumstances mentioned in category ‘E’ and retire subsequently shall have on option as follows.

    (a) to draw lump sum compensation in lieu of war injury element foregoing war injury element at the time of subsequent retirement.

    Or

    (b) to draw war injury element at the time of retirement in addition to retiring pension admissible on retirement, foregoing lump sum compensation.

    The rate of war injury element for 100% disability on retirment / discharge from service shall be 30% of emolument last drawn subject to minimum of Rs. 3510/- PM for 100% disability. for disability less than 100% pension shall be reduced proportionally.


    Lump-Sum Compensation in lieu of War Injury Pension


    In case an officer is found to have a disability which is sustained under the circumstances mentioned in category E of Disability which is assessed at 20% or more for life but the officer is retained in service despite such disability and opts for lump sum compensation, he shall be paid the lump sum compensation in lieu of war injury element.

    The rate of war injury element for 100% disability on retirement / discharge from service shall be 30% of emolument last drawn subject to minimum of Rs. 3510/- PM for 100% disability. For disability due to war injury less than 100%, the rates shall be proportionately reduced.

    The one time compensation in lump sum in lieu of war injury element will be equal to the capitalized value of war injury element.

    Age next birth day will be reckoned with reference to the date of onset of disability with loading to age, if any, recommended by the Competent Medical Board.

    Once the compensation in lieu of war injury element due to disability for life has been paid, there shall be no further entitlement on account of such a disability at the time of retirement form Armed Forces. Since this is one time payment of compensation, no restoration will be permitted.


    War Injury Element on Subsequent Reitrement


    Where an officer is retained in service despite injury/disability sustained under the circumstances mentioned in Category ‘E’ and does not opt for lump sum compensation in lieu of war injury, he shall be entitled to the payment of war injury element on a monthly basis at the rate prescribed in above Para above on subsequent retirement.

    For disabilities less than 100 %, the above rate shall be proportionately reduced. No war injury shall be payable for disabilities less than 20 %.
